2. Purpose of Processing

At Nubemsystems, S.L. we process the information provided to us by data subjects for the following purposes:

• Contact form: to manage information requests received through nubemsystems.es.
• Book a call: to handle telephone contact requests exclusively.
• Email: to manage requests received by email.
• Social media: data published on social media will be processed in accordance with the policies of each platform.
• Virtual assistant (chatbot): to manage conversations held with our artificial intelligence assistant and, if you expressly provide your details, to forward them to our sales team. To generate responses, the conversation content is transmitted to Anthropic PBC (United States) as a data processor, on the basis of the safeguards set out in Article 46 GDPR (Standard Contractual Clauses or an equivalent mechanism).
• Video-call booking: to manage meeting scheduling through the Google Calendar widget, to which the data you enter (name, email and, where applicable, meeting notes) is transmitted. Provider: Google Ireland Limited / Google LLC (United States), in accordance with the safeguards of Article 46 GDPR.
• Web analytics (Google Analytics 4): to analyse website usage on an aggregated basis, only if you accept analytics cookies via the cookie banner. Data processed by Google Ireland Limited / Google LLC (United States), in accordance with the safeguards of Article 46 GDPR.

3. Legal Basis

We process data needed to handle requests and manage meetings on the basis of pre-contractual steps requested by the data subject; analytics is based on consent. Where applicable, we process data to comply with legal obligations or on our legitimate interest in managing and improving the commercial relationship, without overriding individuals' rights.

4. AI Products and Solutions

When Nubemsystems provides an AI solution to a customer, data processing is governed by the applicable contract and, where appropriate, by a data processing agreement. Each implementation defines purpose, access, providers, retention and security measures. Agents are configured with limited permissions and relevant actions require human validation where agreed.

3. Data Retention Periods

• Prospective clients without a contract: data will be automatically deleted one year after the last communication.
• Active clients: data will be retained for the duration of the business relationship and for the time necessary to comply with any legal obligations arising therefrom.
• Chatbot conversations: are not stored on our servers beyond the browser session; the content sent to Anthropic to generate the response is retained in accordance with that provider's retention policy.

5. Data Subject Rights

Any person has the right to obtain confirmation as to whether Nubemsystems, S.L. is processing personal data concerning them. In particular, they may exercise the rights of access, rectification, erasure, objection, restriction, portability and withdrawal of consent.

To exercise these rights, you may contact rgpd@nubemsystems.es stating the right you wish to exercise and enclosing a copy of your identity document.

If you believe your rights have not been addressed, you may lodge a complaint with the Spanish Data Protection Agency.
